This page explains, in plain language, what we guarantee about the Skin, Hair, and Homme elixirs we hand-craft, for how long, and what remedies are available if something isn't right — wherever in the world your order is delivered.
Why This Policy Exists
This Warranty & Limitation of Liability Policy explains what La Bâché LC Bryant LLC ("La Bâché," "we," "us," or "our") guarantees about the products sold on shoplabache.com — our Skin, Hair, and Homme collections, including the Blueberry Luxé Élixir Facial Serum, Élixir Romarin Rosemary Mint Hair Oil, and the Parfum D'Homme Serum and Balm — and what happens if a product arrives defective, damaged, or otherwise not as described.
We are a small, women-owned and family-led company based at 6560 N Mascher Street, Philadelphia, Pennsylvania 19120, United States. Every product is hand-formulated and packaged in small batches, and we ship to customers across the United States, Japan, and Europe. Because a single warranty statement cannot honestly speak to three very different legal systems, this policy sets out our own commitments first, and then explains — region by region — the additional statutory protections that apply to you regardless of anything written above them.
This policy should be read together with our Refund Policy, Shipping Policy, Terms of Service, Privacy Policy, and Legal Notice. Where a conflict exists between this page and mandatory consumer-protection law in your country or state, the law that protects you controls.
Plain-language summary. We stand behind the quality of every bottle we hand-fill. If a product you receive is defective, damaged in transit, or materially different from what you ordered, tell us within 30 days of delivery and we will replace it or refund you — your choice. This warranty does not cover misuse, results that vary from skin to skin, or ordinary shelf life once opened. Nothing here limits any right you already have under the law of your own country or state.
Our Limited Product Warranty
We warrant that, at the time of shipment, each La Bâché product is:
- Free from manufacturing defects in materials and workmanship, including the bottle, pump, dropper, and closure it ships in.
- Formulated, filled, and labeled in accordance with the ingredient list and product description shown on shoplabache.com at the time of your order.
- Filled to the stated volume and packaged to survive standard domestic and international parcel shipping when handled by the carrier in the normal course of transit.
- Free of contamination or foreign material at the point our small-batch production run is sealed and released for sale.
This is a limited warranty. It is the only warranty we make about our products, and it takes the place of every other warranty, express or implied — including, to the fullest extent permitted by law, any implied warranty of merchantability or fitness for a particular purpose — except for the statutory rights described in Sections 8 and 9, which we cannot and do not limit.
Warranty Period & What It Covers
Our limited warranty runs for 30 days from the date of delivery, as recorded by the shipping carrier's tracking confirmation. The cards below summarize what falls inside and outside that coverage.
Manufacturing Defects
Formula separation not caused by heat exposure, a faulty pump or dropper, mislabeling, or a seal that fails on first use.
Covered — 30 DaysTransit Damage
Bottles that arrive cracked, leaking, or under-filled due to mishandling by the carrier between our studio and your door.

Not CoveredExclusive Remedy — Replacement or Refund
If, within the 30-day warranty period, we confirm that a product you received is genuinely defective, damaged in transit, or not as described, your sole and exclusive remedy — and our entire liability — is, at La Bâché's option:
- Replacement of the affected item with the same product from a current batch, shipped at no additional cost to you; or
- A full refund of the purchase price paid for the affected item, issued to your original payment method.
We do not offer store credit as a substitute for a warranty remedy unless you request it. Shipping charges for the original order are refunded only where the product itself is confirmed defective or was damaged in transit; shipping charges are not refunded where a claim falls outside the exclusions described in Section 5.
This exclusive remedy does not apply where mandatory consumer law in your jurisdiction gives you an independent right to repair, price reduction, or contract termination in addition to, or instead of, replacement and refund — see Sections 8 and 9.
What This Warranty Does Not Cover
Because our elixirs are natural, small-batch formulas rather than mass-manufactured cosmetics, the following are expressly excluded from this warranty and are not treated as defects:
- Improper storage. Exposure to direct sunlight, heat above room temperature, or freezing temperatures during transit delays outside our control, or once the product is in your possession.
- Misuse. Application contrary to the instructions on the product label or listing, use on broken or irritated skin without a patch test, or use beyond the recommended frequency.
- Modification or tampering. Any decanting, dilution, re-bottling, or mixing with other products, tools, or ingredients not supplied by La Bâché.
- Normal variation. Minor differences in color, scent intensity, or texture between batches, which are an expected characteristic of small-batch, natural formulation and are not defects.
- Ordinary wear and shelf life. Natural oxidation, scent fade, or separation that occurs after the product's stated shelf life or period-after-opening (PAO), shown by the jar symbol on the packaging.
- Allergic or sensitivity reactions that are not caused by a manufacturing defect — see Section 6 below.
Patch test recommended. As with any skincare, hair, or grooming product containing natural botanical extracts, we recommend applying a small amount to the inner forearm and waiting 24 hours before first full use, particularly if you have known sensitivities or allergies to plant-derived ingredients.
No Warranty on Satisfaction or Results
Skin, hair, and skin-adjacent facial hair respond individually to any topical formula, botanical or otherwise. We do not warrant, promise, or guarantee that any product will produce a specific cosmetic result, resolve a particular skin or hair concern, or work identically for every person who uses it. Marketing descriptions of how a formula is intended to look, feel, or perform describe the product itself and its ingredients — they are not a guarantee of individual outcome.
If you are unsatisfied with how a product performs for you personally, rather than because it is defective or damaged, that dissatisfaction is not covered by this warranty. It may, however, be eligible for return under the timeframes and conditions described in our Refund Policy, which governs change-of-mind and non-defect returns separately from this page.
Nothing in this section limits your rights concerning products that are genuinely defective, unsafe, or not as described, which remain covered under Sections 2 through 4 above and the statutory rights in Sections 8 and 9.
Limitation of Liability & Damages
To the fullest extent permitted by applicable law, and except where mandatory consumer protection law provides otherwise (see Sections 8 and 9), La Bâché LC Bryant LLC's total liability arising out of or relating to your purchase of any product — whether based in contract, tort (including negligence), strict liability, or any other legal theory — is limited to the amount you actually paid for the specific product giving rise to the claim.
To the same extent permitted by law, La Bâché is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or the cost of substitute products, even if we have been advised of the possibility of such damages and even if the exclusive remedy described in Section 4 fails of its essential purpose.
- This limitation applies to claims arising from the use, misuse, or inability to use a product, and to claims arising from delayed, lost, or damaged shipments once handed to the carrier, except as provided in Sections 3 and 4.
- This limitation does not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any defective product under applicable product-liability law, or for any other liability that cannot lawfully be excluded or limited in your jurisdiction.
- Where a jurisdiction does not allow the exclusion or limitation of certain damages, our liability in that jurisdiction is limited to the smallest extent permitted by that jurisdiction's law.
This section does not remove any right you hold under mandatory law. Product-liability protections, statutory guarantee rights in the European Union and United Kingdom, consumer-contract protections in Japan, and state implied-warranty rights in the United States continue to apply in full — see Sections 8 and 9.
Rights That This Policy Cannot Limit
This Warranty & Limitation of Liability Policy is our own commercial commitment, offered on top of — never instead of — the consumer protections that already apply to you by law. Nothing in this policy reduces, excludes, or otherwise affects:
- Any non-waivable implied warranty of merchantability or fitness for purpose recognized under the law of your U.S. state, or your rights under the federal Magnuson-Moss Warranty Act where it applies to a written warranty.
- Your right, as a consumer in the European Union or United Kingdom, to a product that conforms to the contract at delivery, including the statutory guarantee periods described in Section 9.
- Your rights as a consumer in Japan under the Consumer Contract Act and Japan's Product Liability Act, including protection against unfair contract terms and liability for defective products that cause harm.
- Any right to a remedy for a product that is unsafe, mislabeled, or otherwise defective under applicable product-liability or consumer-protection law, regardless of the 30-day period described in Section 3.
Where any clause of this policy conflicts with a right described above, that clause is limited only to the extent necessary to comply with the applicable law, and the remainder of this policy continues in full force.
United States, Japan & Europe
La Bâché ships to all three regions, so this section explains — on each region's own terms — how our warranty interacts with local law. Select a region below.
Federal & State Warranty Law
Under the federal Magnuson-Moss Warranty Act, our limited warranty is a written warranty and this page discloses its terms plainly: what is covered, for how long, and what remedy you receive. Where your state recognizes an implied warranty of merchantability, that implied warranty remains in effect for as long as your state's law provides, regardless of the 30-day period stated in Section 3, unless your state permits — and we have validly limited — the duration of implied warranties to match our express warranty period.
A number of states additionally regulate the disclosure of return, refund, and warranty terms at the point of sale, and several restrict or prohibit "final sale" language on damaged or defective goods. We follow the disclosure and remedy standards described on this page nationwide, and we honor state-specific consumer-protection requirements where they provide broader rights than described above.
Implied warranty of merchantability applies to consumer goods sold in California and cannot be disclaimed on goods sold with a written warranty.
Implied warranty protections under the Uniform Commercial Code, plus a general prohibition on deceptive trade practices in warranty disclosures.
Our home state: implied warranty of merchantability under the UCC, and the Unfair Trade Practices and Consumer Protection Law govern how we describe coverage.
Implied warranty of merchantability may not be disclaimed by any consumer-goods seller, regardless of "as is" language.
Each restricts a seller's ability to disclaim implied warranties on consumer goods more strictly than the model UCC text.
Implied warranties of merchantability and, where applicable, fitness for a particular purpose apply as adopted in each state's version of the UCC.

Consumer Contract Act & Product Liability Act
If you purchase from Japan, Japan's Consumer Contract Act (Act No. 61 of 2000) renders void any contract term that would fully exempt a business from liability for damage caused by its own willful misconduct or negligence, or that would unreasonably restrict a consumer's cancellation rights. Where any clause in Section 7 of this policy would otherwise have that effect under Japanese law, it is limited only to the extent the Consumer Contract Act requires.
Separately, Japan's Product Liability Act (Act No. 85 of 1994) holds a manufacturer liable for injury or property damage caused by a defect in a product, independent of any warranty period stated on this page. This right exists regardless of the 30-day warranty window described in Section 3.
Cancellation Rights
Contract terms that unreasonably restrict your right to cancel for a seller's breach are not enforceable against you under the Consumer Contract Act.
Defect Liability
Liability for injury or property damage from a genuinely defective product survives independently of this policy's 30-day period under the Product Liability Act.
Specified Commercial Transactions Act
As a mail-order seller, we disclose return conditions, cancellation terms, and this warranty clearly in accordance with the Act on Specified Commercial Transactions.
Your Rights
You may contact us using the details in Section 12 to request clarification of any warranty term as it applies to a Japan-based order.
Statutory Conformity Guarantee
If you purchase from the European Union, the wider European Economic Area, or the United Kingdom, your goods must conform to the contract at the time of delivery under the EU Sale of Goods Directive (2019/771) as implemented into the national law of each member state, and, in the UK, under the Consumer Rights Act 2015. This statutory guarantee lasts a minimum of two years from delivery in the EU/EEA, and goods must be of satisfactory quality, fit for purpose, and as described for a reasonable period under the Consumer Rights Act 2015 in the UK.
This statutory guarantee exists independently of, and lasts considerably longer than, the 30-day period described in Section 3 of our own limited warranty. Nothing in Sections 2 through 7 of this policy shortens, replaces, or otherwise limits it. Where a non-conforming product is confirmed, you are entitled to repair or replacement in the first instance and, where that is not possible or proportionate, a price reduction or termination of the contract, in accordance with the law of your country of residence.
Two-Year Minimum Guarantee
The statutory conformity period in the EU/EEA runs from delivery and is not shortened by our 30-day limited warranty above.
Repair, Replace, Reduce, or Terminate
Where a product does not conform to the contract, you are entitled to the hierarchy of remedies set out in your national implementation of Directive (EU) 2019/771 or the Consumer Rights Act 2015.
Burden of Proof
A lack of conformity that becomes apparent within one year of delivery (EU/EEA) is presumed to have existed at delivery, unless we demonstrate otherwise.
National Enforcement Bodies
You may raise an unresolved dispute with your national consumer authority — for example, the DGCCRF in France, the Bundesnetzagentur in Germany, or Trading Standards and the Citizens Advice consumer service in the UK.

Share photos of the product and packaging
Clear photos of the defect, the batch code on the bottle base, and the outer shipping box help us confirm the claim quickly and identify the affected batch.
We review and confirm your remedy
Once confirmed as covered under Sections 2 through 4, we will offer a replacement from a current batch or a full refund to your original payment method — your choice.
We process your resolution
Replacements ship at no cost to you; refunds are issued to your original payment method and typically appear within your bank's standard processing window.
Non-defect returns. If you simply changed your mind or a formula wasn't the right fit, that request is handled under our separate Refund Policy, which sets out its own timeframe and conditions distinct from this warranty.
Third-Party Sellers, Wholesale & Retailers
This warranty applies to products purchased directly from shoplabache.com. If you purchased a La Bâché product from an authorized wholesale partner or retail location — including through our wholesale program or our Faire storefront — the return and warranty terms of that retailer may apply in addition to, or in place of, the process described in Section 10; we remain available to assist in confirming a genuine manufacturing defect regardless of where a product was purchased.
Shipping to your address is carried out by independent third-party couriers. Once a package is scanned as delivered by the carrier, La Bâché is not responsible for loss or theft after delivery, though we are glad to help you file a claim with the carrier and will treat verified transit damage in line with Section 3 above.
Changes to This Policy
As La Bâché's product range grows and applicable consumer-protection law in the United States, Japan, and Europe continues to evolve, we may update this Warranty & Limitation of Liability Policy from time to time. When we make a material change, we will update the "Last Updated" date at the top of this page and, where required by law, provide additional notice on the site.
The version of this policy in effect on the date your order was placed governs that order. We encourage you to review this page periodically if you shop with us regularly.
